CONCERNING
THE SEVENTH AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE No. 92/PMK.02/2005 CONCERNING STIPULATION OF KINDS OF CERTAIN EXPORTED GOODS AND TARIFF OF EXPORT LEVY

THE MINISTER OF FINANCE,

Considering:

• a. that based on decision of meeting that is led by Deputy President on August 22, 2007 and coordination meeting of ministers on August 29, 2007, had decided foods stability policy for September 2007;
• b. that based on consideration and proposal of State Minister of Economics Affair, Minister of Trade, Ministry of Industry and Minister of Agriculture to keep on supply of raw material for palm oil and in order to maintain the stability of domestic palm oil price, there is a need to adjust the export levy of Palm, Crude Palm Oil (CPO), and their derivative products;
• c. that based on consideration as intended in sub-paragraph a and sub-paragraph b, which had been reported and had received a Presidential approval on August 31, 2007, it is necessary to stipulate Regulation of The Minister of Finance concerning the Seventh Amendment to Regulation of the Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Kinds of Certain Exported Goods and Tariff of Export Levy.

In view of:

• 1. Government Regulation No. 35/2005 concerning Export Levy of Certain Exported Goods (Statute Book of 2005 Number 82, Supplement to Statute Book Number 4531);
• 2. Presidential Decree No. 20/P/2005;
• 3. Regulation of The Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Kinds of Certain Exported Goods and Tariff of Export Levy.

Observing:

Letter of Coordination Minister of Economics Affair No. S-96/M.EKON/08/2007 dated August 31, 2007 concerning Basic Foods Stability Policy of Rice, Sugar and Palm Oil.

HAS DECIDED:

REGULATION OF THE MINISTER OF FINANCE No. 94/PMK.011/2007 CONCERNING THE SEVENTH AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE No. 92/PMK.02/2005 CONCERNING STIPULATION OF KINDS OF CERTAIN EXPORTED GOODS AND TARIFF OF EXPORT LEVY

Article I

Many provisions in Regulation of the Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Kinds of Certain Exported Goods and Tariff of Export Levy as has already been amended several times by Regulation of the Minister of Finance:

• a. No. 130/PMK.010/2005;
• b. No. 30/PMK.02/2006;
• c. No. 51/PMK.02/2006;
• d. No. 88/PMK.010/2006;
• e. No. 61/PMK.011/2007;
• f. No. 83/PMK.02/2007;

to become as follows:

(1) 2 (two) paragraphs are inserted between paragraph (1) and paragraph (2) of Article 3 become as follows:

"Article 3

(1) Kinds of certain exported goods and tariff of export levy as intendd in Article 2 are decided in this Regulation of the Minister of Finance.

(1a) Provision and tariff of export levy for exported good of Palm, CPO and their derivative products, use following conditions:

(a) For reference price of less than USD 550 (Five hundred and Fifty United States Dollar) per ton, tariff of export levy is attached in Attachment I of this Regulation of Minister of Finance;

(b) For reference price of more than or equal with USD 550 (Five hundred and Fifty United States Dollar) per ton and less than USD 650 (Six hundred and Fifty United States Dollar) per ton, tariff of export levy is attached in Attachment II of this Regulation of Minister of Finance;

(c) For reference price of more than or equal with USD 650 (Six hundred and Fifty United States Dollar) per ton and less than USD 750 (Seven hundred and Fifty United States Dollar) per ton, tariff of export levy is attached in Attachment III of this Regulation of Minister of Finance;

(d) For reference price of more than or equal with USD 750 (Seven hundred and Fifty United States Dollar) per ton and less than USD 850 (Eight hundred and Fifty United States Dollar) per ton, tariff of export levy is attached in Attachment IV of this Regulation of Minister of Finance;

(e) For reference price of more than USD 850 (Eight hundred and Fifty United States Dollar) per ton, tariff of export levy is attached in Attachment V of this Regulation of Minister of Finance;

(1b) Reference price as intended in paragraph (1a) is decided by minister who has the responsibility in trade affair, by utilizing the guideline of Rotterdam CIF CPO price."

(2) deleted

2. Amend Attachment by delete Roman Number I.

Article II

This Regulation shall be effective since September 3, 2007.

For public cognizance, the Minister ordered for this joint regulation to be placed on the Statute Book Republic of Indonesia.
